Most Toronto basement apartment projects do not fail on plumbing, wiring or parking. They fail on ceiling height, because a pre-1960s Toronto basement is typically 6 feet to 6 feet 8 inches, and a legal secondary suite needs meaningfully more than that.

That is the whole reason underpinning and second-suite conversions are the same conversation in this city. Everything else in the code is solvable with money and a good designer. Height is solvable only by going down.

Toronto allows the suite. The basement is what says no.

Since 2019, second suites have been permitted as-of-right in detached, semi-detached and row houses across the City of Toronto. Zoning is generally not the obstacle it once was. The obstacle is that the Ontario Building Code sets minimum requirements a dwelling unit has to meet, and an old basement usually misses on height before it misses on anything else.

The commonly applied minimum ceiling height for a secondary suite retrofitted into an existing house is 1.95 metres, which is 6 feet 5 inches, measured over the required area of the room rather than to the lowest duct in the room. There are provisions in the code specific to existing buildings that behave differently from new construction, and the applicable clause depends on the age of the house and how the retrofit is being classified.

The gap you are actually closing

Two things fall out of that table, and they matter.

First, some houses are already close enough that the required minimum is nearly met. If your basement measures 6 feet 4 inches, you are inches away, and the honest answer might be a shallow lowering rather than a full underpinning.

Second, the legal minimum and a good apartment are not the same target. A suite at exactly 6 feet 5 inches is legal and feels like a basement. A suite at 7 feet 6 inches rents faster, holds tenants longer, and reads as a proper floor of the house at resale. The cost difference between lowering to the minimum and lowering to something genuinely pleasant is usually smaller than people expect, because the expensive part is mobilising the crew, the engineer and the permit, not the last eight inches of dirt.

The point

Nobody has ever regretted the extra six inches. Plenty of people regret the ones they saved.

Where the height gets eaten

Measure to the underside of the joists and you will get an optimistic number. The finished height is what the code and your tenant care about, and several things come off the top:

  • Ducts and beams. A main trunk duct running the length of the basement can take four to eight inches across its path. Rerouting or reshaping ductwork to a wider, flatter profile is a normal part of these projects and belongs in the budget.
  • Plumbing drains. Waste lines need slope, and they run where they run.
  • The new slab. A properly built new floor is not just concrete. Gravel base, vapour barrier and slab together take up thickness, all of it below your finished floor level.
  • Finished flooring and any subfloor. Another half inch to an inch and a half.
  • Any dropped ceiling. If you want a ceiling below the joists to hide services, that is more height gone.

The practical consequence: budget your lowering against the finished height you want to stand in, then add the stack-up back. A crew that quotes you "seven feet" without specifying whether that is to joist or to finished ceiling has left you a problem to discover later.

Height is the expensive one, but it is not the only one, and it helps to know the full list before you start so the underpinning scope is designed around it rather than retrofitted to it.

  • A second means of egress, and windows sized so a person can get out. Egress window installation frequently pairs with underpinning because the excavation is already open.
  • Fire separation between the suite and the rest of the house, typically a rated ceiling assembly, along with self-closing doors where required.
  • Interconnected smoke alarms across both units, plus carbon monoxide alarms.
  • Minimum room sizes and ceiling area, which is where benching can quietly disqualify a plan: shaving 18 to 24 inches off the perimeter can push a bedroom below the required area even though the height is fine.
  • A separate entrance, which is where walkouts enter the picture, along with the grading and drainage that a walkout requires.
  • Kitchen and bathroom ventilation, and adequate natural light in habitable rooms.
  • Electrical service capacity, which on an older Toronto house with a 100 amp panel may need attention.

Why this changes the method choice

On a legal-suite project, the benching-versus-underpinning decision is usually settled by room area rather than by budget. Benching costs 20 to 40 percent less, but it takes 18 to 24 inches off the perimeter permanently. In a narrow Toronto semi, that is often the difference between a bedroom that meets minimum area and one that does not.

If you are lowering purely for a rec room, benching deserves serious consideration. If you are lowering to create a legal, rentable, permitted dwelling unit in a house under about 20 feet wide, underpinning is usually the method that survives the plan review.

What it costs, end to end

The underpinning is the largest line but not the only one. For a typical Toronto semi or small detached house:

  • Underpinning: $500 to $750 per linear foot of foundation wall. For 100 to 140 linear feet, that is roughly $50,000 to $105,000.
  • Structural engineering: $1,500 to $2,500 for stamped drawings.
  • Building permit: calculated per linear metre of underpinned wall, with the City's current schedule at $11.89 per linear metre for the underpinning component. The suite itself is permitted separately.
  • Egress window and window well: commonly $3,000 to $7,000 installed.
  • Separate entrance or walkout: $15,000 to $30,000, and materially cheaper bundled with the underpinning than added afterward.
  • Suite fit-out: kitchen, bathroom, flooring, fire separation, electrical and HVAC work, which varies enormously with finish level.

The underpinning portion is the part with the least room for surprise, because it is measurable in linear feet. The fit-out is where budgets drift.

Does benching work for a legal basement apartment?

Sometimes, in a wide basement. In a narrow one it often fails on minimum room area rather than on height, because the bench eats the width. Check the room dimensions on the proposed plan before assuming the cheaper method works.

Do I need a separate entrance?

A second suite requires its own means of egress, and in most basement conversions that means a separate exterior entrance, which is why walkouts and underpinning are so often quoted together.

Will underpinning alone make my basement apartment legal?

No. Underpinning solves height. The suite still needs its own permit, and it still has to satisfy egress, fire separation, alarms, room sizes, ventilation and light. Underpinning removes the obstacle that money alone cannot solve; the rest is a normal permitted renovation.

How long does the whole thing take?

Plan on 3 to 6 months for the underpinning alone once engineering and the 6 to 12 week permit review are counted, then the suite fit-out on top. Anyone promising a finished legal suite in eight weeks has not included the permit.
